Terms of Service

General terms

When using U4Success Services, please note that the term ‘we’ or ‘us’ or ‘U4Success’ refers to the owner of U4Success and the term ‘you’ refers to the person using U4Success Services.

Meanings

For this Terms of Service:

-Company: when this policy mentions “Company,” “we,” “us,” or “our,” it refers to U4Success, (Stromstraße 35, 1200, Vienna) that is responsible for your information under this Terms of Service

-Country: where U4Success or the owners/founders of U4Success are based, in this case, is Austria

– U4Success Services: refers to the services provided by U4Success including regular tutoring sessions, single tutoring sessions, learning support sessions and revision courses.

Tutors and Clients

U4Success reserves the right to modify this Terms of Service. The Clients and the Tutors will be informed of the changes in writing. The changes can take place with immediate effect.

This Terms of Service constitute the entire agreement between U4Success, the Client and the Tutor.

No other Terms of Service or Terms of Engagement can be proposed and consented to by any of the parties without U4Success written agreement. U4Success also must consent in writing to modifications of this Terms of Service should any changes be valid.

The automatic consent to this Terms of Service is assumed by accepting to participate or use U4Success Services by the Client or the Tutor.

Clients

U4Success acts as an agent on behalf of the Tutor and the Client. The Tutor is introduced to the Client by U4Success. This Terms of Service constitute the entire agreement between U4Success, the Client and the Tutor and must be accepted by the Client before the commencement of any tutoring.

Tutors

U4Success acts as an agent on behalf of the Tutor and the Client. The Tutor is introduced to the Client by U4Success. This Terms of Service constitute the entire agreement between U4Success, the Client and the Tutor and must be accepted by the Tutor before the commencement of any tutoring.

Private Arrangements

A Tutor is not permitted to make any private arrangements with a Client that was introduced to the Tutor by U4Success. In case of non-compliance U4Success is entitled to the full amount that was paid to the Tutor by the Client. U4Success then has the right to obtain an injunction against the Tutor and the Client to prevent future incidents.

Similarly, a Client is not permitted to make any private arrangements with a Tutor that was introduced to the Client by U4Success. In case of non-compliance U4Success is entitled to the full amount that was paid to the Tutor by the Client. U4Success then has the right to obtain an injunction against the Tutor and the Client to prevent future incidents.

Liability

After the introduction made by U4Success, no liability is accepted by U4Success for any claim made by the Client that is to do with the tutoring carried out by a Tutor. U4Success only accepts responsibility for finding a matching Tutor for the Client and not for what transpires during the tutoring session.

Fees and Payment

U4Success handles the payment of all tutors. The Tutor never receives the payment directly from the Client. Instead, the Client prepays the U4Success Services by purchasing the block of the agreed number of sessions that can be used within the agreed amount of time. Out the Client agrees to on demand payment at the end of every month based on the amount of sessions that took place that month. In that case no discount rates apply unless otherwise agreed. The payments can be carried out directly at the U4Success office or by invoice. The Client must transfer the payment to U4Success within ten days of the date of the invoice. This is accomplished by Bank Transfer or cash payment.

U4Success reserves the right to send a Reminder Notice to the Client in the event of late or non-payment. The first Reminder Notice entails no interest for the delayed payment. The second Reminder Notice comes with a 10% interest from the original invoice.

The fee is agreed upon before the commencement of any tutoring. No changes to the fee can be made between the Client and the Tutor without written consent from U4Success.

The Tutor will be paid by U4Success in the preferred payment method. The Tutor will submit an invoice to U4Success for the number of hours they tutored each Client. The Tutor is responsible for writing down their hours. In case of any questions by the Client regarding the tutoring hours, all the tutoring hours are recorded by the Tutor. Again, the Tutor never receives the payment directly from the Client. If such a transaction transpires then the paid amount will be immediately payable to U4Success. This shall be actionable through the Courts straight away.

U4Success is not responsible for the Tutors’ tax and insurance payments. It is up to the Tutor to pay the tax and national insurance contributions that they must pay.

Expenses

All expenses must be agreed upon between the Client, the Tutor and U4Success before the commencement of any tutoring. If the Tutor sustained the agreed expenses the Tutor must keep all the receipts and he/she will be refunded for the expenses. No expenses that were not agreed upon or for which no proof in form of receipts exists will be refunded to the Tutor.

Free first session

The first thirty (30) minute session is always free-of-charge. This session is meant to get to know each other, learn about the goals for tutoring, to indetify the weaknesses and work out the plan for the subsequent tutoring sessions. If the tutoring is to commence directly on the first session, the corresponsinding tuition fee is to be paid for the time exceeding those free thirty (30) minutes.

Additional costs

Any additional costs and extra expenses (e.g. travel expenses or textbooks) must be agreed upon by the Client and the Tutor before the commencement of any tutoring.

Cancellation policy

In case of any alterations to the plans made for tutoring sessions, the Client and the Tutor must inform each other and U4Success. Cancellation is possible 24 hours before the appointment. If the cancellation occurs less than 24 hours in advance the Client is obliged to pay the full tuition fee for the session. The Tutor must pay a cancellation fee if he/she cancels the tutoring session less than 24 hours in advance. The cancellation fee amounts to 20 euros.

In case of the Client being late for the scheduled session for more than 20 minutes the U4Success and U4Success tutors reserve the right to deem the session expired. The full tuition fee is to be paid for the session. “No-show” situations are only accepted with a valid excuse clearly communicated to U4Success.

Refund Policy

By placing an order or making a purchase at U4Success, you agree to the terms along with U4Success’s Privacy Policy. Refunds are only possible by placing an official refund request either verbally or in written form.

A client is entitled to a refund of the tuition fee if:

• A Tutor failed to deliver the tutoring session without prior cancellation. The Tutor is liable to refund to the Client any tuition fee they might have received for the session. Upon agreement between the Client, the Tutor and U4Success rescheduling is possible instead of the refund. The Tutor must still pay a cancellation fee if he/she cancels the tutoring session less than 24 hours in advance.
• If a Client raises a refund request against U4Success’s service satisfaction assurance. In case a Client is not completely satisfied with the service that we provide the Client can contact us and we will discuss any issues with our service.

Data Protection Act

U4Success collects information from and about our Tutors solely for the services we provide. The Tutors agree to this information being used for the following purposes: shared with the Clients during the introduction, in order to contact the Tutors and for payment.

Confidentiality

In line with this Terms of Service no confidential information concerning the affairs, customers, clients, business or suppliers or tutors of U4Success can be disclosed by the Client or the Tutor. Only upon the request by law or government can the confidential information of U4Success be disclosed.

Approval

Agreement to these Terms of Service is assumed through acceptance of our services.
